Given the inherent delays by Defendant, Applicants developed other complaints from consistent medication use. At Trial, the Parties settled for $300,000 or 60 times the initial offer.

    Applicant died due to material work exposure. Defendants denied the claim indicating that there was insufficient medical evidence to substantiate that the death happened at work. Upon obtaining medical evidence, Defendants continued to maintain the denial. Seeing their actions as bad faith, Rodich Law filed for Court seeking penalties and sanctions. The day before the matter was to be set for Trial, Defendant accepted liability for the claim and paid full value of all death benefits.
  • Trial Victory For Injury With Repetitive Work Injury
    Applicant, a 62-year-old plasterer filed a continuous trauma claim alleging injury to his bilateral knees, spine and bilateral upper extremities. Defendants initially denied this claim. As a result, we were forced to try this claim in front of the WCAB. An offer by defendants was made in the amount of $10,000. Said offer was rejected. Post winning Award Rodich Law was successful in getting the applicant temporary disability benefits for 104 weeks along with authorization for total knee replacement.. This matter was subsequently resolved by way of Compromise and Release in the amount of a $340,000 lump sum payment to the applicant.

    Applicant was employed has a housekeeper in a nursing facility during the time of the initial stages of COVID. The applicant, along with other cleaners, were employed to go in and clean the facility using solvents and gloves but no protective masks. Subsequent thereto the applicant contracted long term COVID. She went into a coma and thereafter regained consciousness. The applicant was rushed to the emergency room hospital on numerous occasions and almost lost her life more than three times. The insurance company refused to accept the COVID as being industrial.

    A 50-year-old driver loader unloader who worked for a food service delivery company sustained an injury to his neck and back as a result of repetitive lifting.
